When booking rental winter sport equipment through Method Snow School and its affiliates the following terms and conditions apply, without exception. When payment of a deposit is taken it is as an acceptance of the terms and conditions listed below. Here after the person stated on the rental agreement as the recipient of the hire equipment will be called the "client". This agreement starts at the point Method Snow school receives the deposit and ends on the final day stated on the rental agreement, when all equipment/property of Method Snow School has been returned in full, in accordance with the terms and conditions here after. Regardless of these terms and conditions featuring on other 3rd party websites - the Terms and conditions contained here in shall prevail. COST OF HIRE: the cost of hire equipment for the duration agreed is set out in the Method website for the 2007/08 season. SECURITY OF HIRE: A security deposit for the full retail value of the hired equipment will be needed to secure any equipment hire from Method Snow School. The deposit can be paid in cash or by credit or debit card. COLLECTING, RETURNING and AVAILABILITY OF EQUIPMENT HIRE:1:The equipment can be collected the day before the date stated on the hire period as the first day of hire, after 5pm local time. Or on the morning of the date stated as the first day of hire. 2: The equipment must be returned at the end of the last day of hire, before 6pm local time. Equipment returned after 8.30am on the day after the date stated on the rental agreement as the last day of hire will incur one day of extra rental at the prices stated on the Method Snow School website. 3: The equipment remains the responsibility of the client from the time of collection to the time of return. The Client will ensure its conservation and will make use of the equipment with due diligence at all times. 4: The equipment should not be used for any other purpose than that described by the manufacturer and the terms here in. The rental equipment remains the sole responsibility of the client during the period stated on the rental agreement. 5: In case of late collection of the rented equipment, the client shall inform Method Snow School as soon as possible. Method Snow School will endeavor to keep the booked equipment at the clients disposal for 24 hours. After this the equipment shall be made available for renting again, without compensation due to the client. 6: The hired equipment shall be returned to the where it was collected from, unless otherwise confirmed by a member of the Method Snow School. 7: Failure to return the rented equipment, regardless of the reason will result in Method Snow School billing the client for the full value of the equipment, at its retail price as new, as stated in clause 1 of Loss, Theft and damage, in addition to the cost for the hire period. 8: Method Snow School cannot be held liable for delays in the availability of the rented equipment due to the circumstances beyond their control. This includes equipment returned late from previously rented equipment or necessary modifications to equipment. 9: In circumstances such as those mentioned in (clause 8) Method Snow School will do their best to make available to the client equipment of equal or higher quality according to stock availability. 10: All equipment available for hire is recognized as being in good condition and shall be returned as such. The equipment is numbered or marked shall be returned by the client with the same numbers and the same mark. In the case of the equipment being returned without the correct numbers or marks the client will be deemed to have changed the equipment. The full Value of the rented equipment (according to clause 1 of loss, theft and damage) will then be taken. 11: Any damage, regardless of the cause, will result in the direct payment for the replacement or repair fees, in addition to the cost of hire, within the maximum limit of the equipment value as new. USE OF THE HIRED EQUIPMENT 2: The equipment is not to be leased or loaned during the period of hire. 3: The client is sole judge of their ability to use the equipment for the agreed rental period. 4: Method Snow School cannot be held responsible for any damage caused to the equipment, or injury caused to the client as a result of any misuse of the equipment, or use of the equipment in situations beyond the client's ability. (If the client is in doubt about their ability, Method Snow School Instructors will be able to guide the client as to their ability). 5: Method Snow School cannot be held responsible for any damage or injury caused to third parties as a result of the client's use of any of their equipment. 6: All equipment available for hire is recognized as being in good condition and shall be returned as such. The equipment is numbered or marked shall be returned by the client with the same numbers and the same mark. Any damage, regardless of the cause, will result in the direct payment for the replacement or repair fees, in addition to the cost of hire, within the maximum limit of the equipment value as new. LOSS, THEFT AND DAMAGE - 1: In the event of loss or theft of the equipment or damage beyond reasonable repair. Method Snow School will take the full amount of the security deposit for each item of the equipment. The full retail costs charged for the loss or theft of equipment is as follows, 499 leva Per SNOWBOARD, 270 leva per pair of BINDINGS and 250 leva per pair of BOOTS 2: In the case of loss of theft of equipment the clients insurance will cover the costs, should the policy state cover for this eventuality. The client is therefore responsible for acquiring the relevant forms and paper work from the relevant local authorities. 3: Method Snow School cannot be held responsible for any action the client has to take to resolve policy issues with their own insurance company. However Method Snow School will do their best to assist the client in anyway they can with this matter. 4: In the case of theft, Method Snow School will provide a full receipt for the total costs as stated in clause 1 of loss, theft and damage. This receipt can then be given to the clients Insurance company as proof of the charges made to the client. 5: When equipment is damaged beyond reasonable repair and Method Snow School has received full payment for the damaged equipment at the rates stated in clause 1 of loss, theft and damage, the client will receive all the damaged equipment. The damaged equipment is then the property of the client and can be used as proof of damage beyond repair to the clients insurance company. 6: Any damage to the hire equipment regardless of the cause will result in the direct payment for the replacement or repair (cost of repair to be determined by Method Snow School) in addition to the cost of the hire, according to the prices stated in clause 1 of loss, theft and damage. CANCELLATION POLICY 1: In cases of cancellation of equipment hire before 14 days (inclusive) of the beginning of the hire period, the client will be charged 25% of the total hire costs. 2: In cases of cancellation of equipment hire between 7 and 13 days (inclusive) of the beginning of the hire period, the client will loose any deposit paid for the total hire costs. Usually 50%. 3: In cases of cancellation of equipment hire less than 7 days before the beginning of the hire period, and full payment has been made then no refund shall be given. The client will loose any deposit paid for the total hire costs, if full cost have not been paid. 4: In the case of a clients illness or accident during the hire period, resulting in the client being unable to use the equipment at any point during the rental period, no refund will be given. In this case a receipt will be issued for the cost of the hire for the purposes of the clients insurance should they wish to claim from their own insurance company, depending on the stipulations in the clients policy. 5: Cancellations or clients unable to use the hired equipment due to weather conditions resulting in the full closure of the ski area, no refund will be given. The client is advised to gain confirmation from the resort operator. This will enable the client to claim the cost of equipment hire for the day/s of closure from the clients own insurance company, depending on the stipulation in the client's policy.
